Terms of Service

1. Agreement to Terms

By accessing or using ExamCove, you agree to be bound by these Terms of Service. If you do not agree, do not use the platform. We may update these terms from time to time—continued use after changes constitutes acceptance.

2. Description of Service

ExamCove provides AI-powered tutoring services including voice conversations, live whiteboard explanations, and adaptive learning tools. The service is designed for educational purposes and is not a substitute for professional academic advice or accredited instruction.

3. Account Registration

You must provide accurate, complete information when creating an account. You are responsible for maintaining the security of your account credentials. You must be at least 13 years old to use ExamCove. Users under 18 must have parental or guardian consent. You may sign up using email and password or through third-party identity providers (Google, Apple, Microsoft). When using social login, you are also subject to those providers' terms of service.

4. Subscriptions & Billing

ExamCove offers paid plans billed monthly on a recurring basis: Essay Pro ($29/month) includes unlimited essay reviews; Tutor Pro ($89/month) includes 900 tutor minutes (15 hours) per month plus unlimited essay reviews; Elite ($169/month) includes a guidance threshold at 1,200 tutor minutes (20 hours) and a hard cap at 1,800 tutor minutes (30 hours), plus unlimited essay reviews and access to orchestration and avatar features. No annual billing option is currently available, and no free trials are offered. Your subscription renews automatically unless canceled before the renewal date. You may cancel at any time; access continues through the end of your billing period. We offer a full refund within 30 days of purchase if the service is not the right fit.

5. Free Plan & Usage Limits

We offer a Free plan ($0/month) that does not require a payment method. The Free plan includes up to 5,000 essay-review words per month. Paid plans include the following monthly tutor-minute budgets: Tutor Pro includes 900 minutes (15 hours, hard cap); Elite includes a guidance threshold at 1,200 minutes (20 hours) and a hard cap at 1,800 minutes (30 hours). On the Elite plan, each orchestration run consumes 10 tutor minutes from your monthly budget. Essay Pro and above receive unlimited essay reviews with no word cap. All usage budgets reset on the 1st day of each UTC calendar month. Usage caps exist to protect service quality and manage third-party infrastructure costs.

6. Acceptable Use

You agree not to: use the service for any unlawful purpose; attempt to reverse-engineer, copy, or redistribute ExamCove's AI models or content; share your account credentials with others; use the platform to generate content for academic dishonesty; or interfere with the service's operation.

7. Intellectual Property

All content, features, and functionality of ExamCove—including AI models, whiteboard visuals, curriculum design, and branding—are owned by ExamCove and protected by intellectual property laws. Your learning data and notes remain yours.

8. Privacy Policy

Your use of ExamCove is also governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy describes how we collect, use, and protect your personal information. Please review it at examcove.com/privacy.

9. GDPR & COPPA Compliance

If you are located in the European Economic Area (EEA), you have rights under the General Data Protection Regulation (GDPR), including the right to access, correct, or delete your personal data. To exercise these rights, contact us at legal@examcove.com. ExamCove is not directed at children under 13. In compliance with the Children's Online Privacy Protection Act (COPPA), we do not knowingly collect personal information from children under 13 without verifiable parental consent. If we become aware that a child under 13 has provided personal information without parental consent, we will delete it promptly.

10. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. You agree that any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.

11. Dispute Resolution & Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of ExamCove shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except that either party may bring claims in small claims court if they qualify. You waive any right to a jury trial and any right to participate in a class action lawsuit or class-wide arbitration. To initiate arbitration, send a written notice to legal@examcove.com. Nothing in this section shall prevent either party from seeking injunctive or other equitable relief in court for violations of intellectual property rights.

12. Limitation of Liability

ExamCove is provided "as is." We do not guarantee specific academic outcomes, grades, or test scores. To the maximum extent permitted by law, ExamCove shall not be liable for any indirect, incidental, or consequential damages arising from use of the service.

13. Termination

We reserve the right to suspend or terminate accounts that violate these terms. You may delete your account at any time. Upon termination, your right to use the service ceases immediately, though we may retain anonymized learning data for service improvement.
